Coming into force of Counterpart Execution legislation

On 1 July 2015 the Legal Writings (Counterparts and Delivery) (Scotland) Act 2015 will come fully into force. It is the first Act to pass through the new legislative procedure in the Scottish Parliament for Scottish Law Commission Bills. The legislation is based on a Report published as part of our current review of contract law. It will provide that documents signed in counterpart are legally effective under Scots law. In addition, it will permit paper documents to be delivered, for legal purposes, by electronic means such as by fax or as a scanned attachment to an email.
