Goodbye “tacit relocation”, hello “automatic continuation”!

The Scottish Law Commission publishes Report on Aspects of Leases: Termination along with a summary and news release.  

The law of tacit relocation together with certain provisions of the Sheriff Courts (Scotland) Act 1907 and the Removal Terms (Scotland) Act 1886 represent an uncertain, insufficiently accessible and outdated miscellany of legal rules. Our recommended reform aims to ease the process of leasing commercial property with a modern systematic legal code.
