Major review of mortgage law: Discussion Paper on Heritable Securities: Non-monetary securities and sub-securities

The Scottish Law Commission has published a Discussion Paper on Heritable Securities: Non-monetary securities and sub-securities today.
The Discussion Paper is part of our wider project on mortgage law in Scotland and considers two discrete, complex issues, namely heritable securities in respect of non-monetary obligations and sub-security arrangements.
While these type of transactions are mainly relevant to those in the commercial property and finance sectors, the Commission is very keen to hear from everyone with an interest in the issues raised in the Discussion Paper. The consultation is open for comment until 29 September 2023.
